The Divorce Process in Colorado
Every divorce is unique, but most cases in Colorado follow a similar path. Here’s what you can expect:
1. Consultation & Case Review

2. Filing the Petition & Serving Your Spouse
One spouse files the Petition for Dissolution of Marriage in the county court. To file, you (or your spouse) must have lived in Colorado for at least 91 days. If children are involved, they must have lived in the state for at least 182 days. The petition and summons must then be served on the other spouse.
3. Response by the Other Party
The responding spouse has 21 days to reply if served in Colorado, or 35 days if served outside the state. This begins the official case timeline.
4. Initial Status Conference
Within about 42 days of filing, the court holds an Initial Status Conference. This is not a trial—it’s a scheduling and planning session to set deadlines, discuss any immediate issues, and decide if temporary orders are needed.
5. Financial Disclosures
Colorado law requires both parties to exchange full financial disclosures within 42 days of filing or being served. This includes a Sworn Financial Statement and supporting documents like tax returns, pay stubs, bank statements, and a certificate of compliance.
6. Temporary Orders (if needed)
During the divorce, courts may issue temporary orders for child custody, parenting time, child support, or spousal maintenance. These remain in effect until the final divorce decree is issued.
7. Negotiation & Mediation
Most Colorado courts require parties to attend mediation. This step gives both spouses the chance to resolve disputes outside of court, saving time and money. Many divorces are settled at this stage.
8. Permanent Orders Hearing (Trial)
If you cannot reach an agreement, the case proceeds to a Permanent Orders Hearing. At this trial, a judge decides on any unresolved issues, including custody, support, and property division.
9. Mandatory Waiting Period
Even if both spouses agree on all terms, Colorado requires a 91-day waiting period from the date of filing before the divorce can be finalized.
10. Final Decree of Dissolution of Marriage
The process concludes with the court issuing a Final Decree, which legally ends the marriage and sets forth custody, support, and property division arrangements.
